Deadline for complying with the New Bioengineering Rule
The National Bioengineered Food Disclosure Standard states an absolute compliance date of January 1, 2022, and an implementation date of January 1, 2020. In the interim (up until December 31, 2021), companies may voluntarily disclose bioengineered (BE) foods and food ingredients by state or locally mandated methods, or through the use of auxiliary markings such as stickers or ink stampings.
The implementation date refers to the date that individual states may adopt identical requirements to the national standard and impose remedies for violations of their standards including monetary damages and injunctive relief. The implementation date for companies with $10 million or more in annual food sales is set as January 1, 2020. Companies with less than $10 million in annual food sales have an extra year for implementation, by January 1, 2021.
